Quốc hội đã thông qua Luật sửa đổi, bổ sung một số điều của Luật Địa chất và khoáng sản. Luật này có hiệu lực từ đầu tháng 1.2026.

Luật quy định, đất hiếm là khoáng sản chiến lược đặc biệt. Hoạt động điều tra, đánh giá, thăm dò, khai thác, chế biến và sử dụng đất hiếm phải tuân thủ chiến lược quốc gia về đất hiếm, quy hoạch về đất hiếm.

Đất hiếm phải được bảo vệ, khai thác, sử dụng hợp lý, tiết kiệm, hiệu quả gắn với yêu cầu phát triển bền vững kinh tế - xã hội, bảo đảm quốc phòng, an ninh của đất nước.

Về hoạt động thăm dò, khai thác, chế biến đất hiếm phải được kiểm soát chặt chẽ; không xuất khẩu thô khoáng sản đất hiếm; chỉ các doanh nghiệp, tổ chức được Nhà nước chỉ định hoặc cho phép mới được quyền thăm dò, khai thác, chế biến và sử dụng đất hiếm.

Deep processing of rare earths must be associated with building a modern industrial ecosystem to enhance the domestic value chain, ensuring autonomy in implementing the national strategy on rare earths.

Còn thông tin, dữ liệu địa chất, khoáng sản đất hiếm phải được xây dựng đồng bộ, quản lý tập trung, thống nhất và được khai thác, sử dụng có hiệu quả.

The State encourages international cooperation in research, transfer, and development of mining, selection, separation, and deep processing of rare earth technologies to serve the development of the domestic rare earth industry.

Supporting the training of high-quality human resources, meeting the requirements of expertise, techniques and technology in the chain of geological survey, assessment, exploration, exploitation, deep processing of rare earths, application and management of rare earths.

The State has policies to reserve and protect rare earths, regulate the export and import of rare earths in each period in accordance with the goals of sustainable socio-economic development and ensuring resource security.

Regarding reserves and protection of rare earth minerals, the Law stipulates that the area of rare earth mineral reserves is an area with rare earth minerals but not yet exploited, which needs to be protected and determined based on the results of geological surveys on minerals and the results of rare earth mineral exploration.
